Terms of Service

These Terms of Service ("Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "your"), and Anas Sheikh Ibrahim ("we", "our", or "us"), concerning your access to and use of our mobile apps (GrowthCalc and Neo-Calc) as well as any other related products and services (collectively, our "Products and Services").

You agree that by accessing our Products and Services, you have read, understood, and agree to be bound by this Agreement and our Privacy Policy. If you do not agree to be bound by this Agreement or our Privacy Policy, then you are expressly prohibited from using our Products and Services and must discontinue usage immediately.

This Agreement shall remain in full force and effect while you use our Products and Services. Without limiting any other provision of this Agreement, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of our Products and Services to any person for any reason, including for breach of any representation or covenant contained in this Agreement or of any applicable law or regulation. We may terminate your use of our Products and Services without warning, in our sole discretion.

All products, services, and information included in our Products and Services, either directly or by linking to third-party websites, are intended solely for educational purposes and are not intended to replace any medical treatment, advice, or diagnosis from a healthcare professional. Data shown in our Products and Services should not be considered as a substitute for advice from a medical professional. We do not recommend self-management of health issues. Information in our Products and Services is not comprehensive, and we recommend that you contact your medical professional immediately should you have any health-related questions. We strongly advise against disregarding or delaying medical advice or treatment based upon data measured by our Products and Services.

Our Products and Services do not store any personal information, and the data provided by the User is solely used for the calculation of the results of its measurement, excluding the name, which is displayed on the charts. We are not liable for any damages whatsoever caused by the misuse of our Products and Services. We make no guarantee or warranty with respect to any products or services sold. Our Products and Services are provided on an "as-is" and "as-available" basis. You agree that your use of our Products and Services will be at your sole risk.

There may be information on our Products and Services that contains errors, inaccuracies, or omissions related to our Products and Services, including descriptions, availability, and various other information. We reserve the right to correct any such errors, inaccuracies, or omissions and to change or update the information on our Products and Services at any time.

In no event will we be liable to you or any third party for any direct, indirect, consequential, punitive, etc. damages arising from your use of our Products and Services. We are not responsible for any damages for information or services provided even if we have been advised of their possibility or likelihood.

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys fees and expenses, made by any third party due to your use of our Products and Services, any breach of this Agreement, or your violation of the rights of a third party.

We cannot guarantee that our Products and Services will be available at all times. We may experience hardware or software problems or need to perform maintenance on our Products and Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, modify, etc. our Products and Services at any time for any reason. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use our Products and Services during any downtime or discontinuance of our Products and Services. Nothing in this agreement will be construed to obligate us to maintain and support our Products and Services or to supply any corrections, updates, or releases in connection therewith. Supplemental Terms of Service or other documents that may posted from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to this Agreement at any time and for any reason.

This Agreement is governed by and construed in accordance with the laws of England and Wales, without regard to principles of conflict of laws.

We will alert you about any changes by updating the "Last updated" section of the Terms of Service page and you waive any right to receive specific notice of each such change.
